What is the ruling for a fasting person who deliberately ate after having sexual relations with his wife in a manner that does not involve penetration and did not ejaculate, believing that he broke his fast?
Answer

If a reliable jurist advised him that he broke his fast by this act, he must make up the fast without expiation. This is different from a situation where he relied on his assumption of breaking the fast without a fatwa, in which case expiation is required. Refer to Bada'i' al-Sana'i' 2: 100.
