How to Apply the Will with Changed Circumstances from the Time of Bequest
A lady entrusted a sum of two thousand dinars to a woman, and bequeathed that if she died, she should give from the amount what is sufficient for the burial and condolence costs for her son, and whatever remains from the amount should be distributed among her four daughters, as she had given all her possessions to her son; however, her son died two days before her and left behind sons and daughters. How should her will be applied?
Answer
I say, and with God's success: She must give the money to the daughters; because it is inheritance, and it is their right only, and the sons of the son do not inherit; because he died before his mother, and God knows best.
